SARMIS EVOLUTION SRL is a Romanian legal entity, headquartered in 119 Barbu Vacarescu Street,
 Bucharest – Romania, identified by registration number assigned by the Trade Register Office attached to the Bucharest Court J:40/13139/2021, fiscal code RO44672330 (hereinafter referred to as "SARMIS").

In carrying out our business, we comply with the legislation in force in the field of consumer protection, combating unfair commercial practices and electronic commerce. We are interested in achieving and maintaining a harmonious relationship with our collaborators, therefore we ask you to carefully read the data and information published on the site, as they define the terms and conditions of our collaboration.

We use our own online platform www.sarmisintl.com (hereinafter referred to as the "SARMIS site") - which we have been managing since its establishment and which makes available to you the information, materials, products and services available, which are subject to and imply acceptance of these terms of use ("Site Terms of Use").

To create an account on the SARMIS website, you must use a valid email address. We may refuse registration if we find or suspect that you have used information that is not in accordance with reality.

The commercial relationship that we propose to our clients and collaborators respects SARMIS's practices and policies, as well as the legislation in accordance with MLM activities, therefore, the quality of collaborator or client is essential for any purchase of our goods or services.

The use of this site is equivalent to the reading, understanding and acceptance by our clients and collaborators of the terms and conditions detailed below. The terms relating to the use of the site may be updated from time to time, depending on the specifics of our activity and legislative developments. The updated versions will be posted on the SARMIS website and are immediately applicable. When using the SARMIS website, we recommend that you periodically check whether the Terms of Use of the website have been updated or modified, as SARMIS may at any time make changes to the content of the website www.sarmisintl.com, changes in structure and accessibility, may cease providing information on the website, without requiring prior consent and without sending any notification to users or third parties.

SARMIS grants you permission, revocable and non-exclusive, to create hyperlinks to the pages of the Website as long as these links are not used in a context that would describe SARMIS in a false, misleading or offensive manner. The license granted will not allow the association of SARMIS's trademarks with other third-party trademarks or names, nor the use of its own trademarks for promotional purposes without the prior written consent of SARMIS EVOLUTION SRL.

The SARMIS Site provides information, business opportunities, SARMIS products and services and is intended for use only in and within Romania and is governed by the laws of Romania. SARMIS disclaims any responsibility and liability for use of the SARMIS Site in other countries.

SARMIS’s failure to act with respect to a breach of any of the terms and conditions set forth herein shall not waive its right to act with respect to future or similar breaches. If a court finds any provision of these terms to be unenforceable or invalid, that provision shall be enforced to the fullest extent permitted by applicable law and the remaining terms shall remain in full force and effect.

Use of materials from the SARMIS website

The materials, trade names and trademarks presented on the site are owned, used and protected by SARMIS under a license or with the permission of the owner of these rights.

The images, texts, web graphics, scripts, software, design rights, registered trademarks, etc. available on the SARMIS site (called "site materials") are also protected in the same way, and may be reproduced, distributed, published or presented by third parties only with the prior written consent of SARMIS.

The customer or collaborator may not assign, delegate or transfer the rights or obligations belonging to SARMIS. The use without the consent of SARMIS of any of the above-listed elements is punishable according to the legislation in force at the time of use.

The use of any registered trademark names of third-party companies on our site does not constitute advertising for the respective companies.

In case of divergence or disagreement between SARMIS and its customers or collaborators, the terms and conditions from the time of the order or from the time of conclusion of the contract with SARMIS will apply.

Limiting access to the site

You can send communications and suggestions to SARMIS, with the idea of improving our products and services. Any of these will be accepted if they are sent in civilized language, without obscene, vulgar, threatening, defamatory or illegal content, if they do not violate intellectual property rights, do not contain viruses, do not serve promotional campaigns that are not related to us, are not mass emails or any other form of spam.

Campaigns with gift products/promotions

SARMIS EVOLUTION SRL organizes promotional campaigns containing gift products, offered during the campaign period per natural or legal person (identified as Client/Collaborator/Partner), regardless of the number of orders registered by a natural or legal person.

In case of identified fraud situations, SARMIS EVOLUTION SRL reserves the right to suspend the accounts thus created and to withdraw the benefits related to ongoing promotions or offers, to cancel orders without prior notice, notification, other formalities or compensation.

Also, if an order with gift products is rejected or returned in full, the customer is obliged to return the gift products in their original condition, undamaged and unopened.

Disclaimer, Indemnification

All information contained in these terms and conditions is provided by SARMIS to interested parties in good faith. SARMIS cannot be held liable for and assumes no responsibility for any damages resulting from the use of the content of the site and cannot guarantee that the site, the servers on which it is hosted or the e-mails sent are free from potentially harmful computer components, that they do not contain errors, omissions, defects, delays or interruptions in operation or transmission, line failures or any other similar factors. SARMIS does not guarantee that the SARMIS site will be compatible with the equipment and software used by you.

SARMIS assumes no responsibility for products or services promoted or marketed through other sites.

SARMIS shall also not be liable for any direct, indirect, consequential or other damages, including but not limited to property damage, loss of use, loss of business, economic loss, loss of data or loss of profits, arising out of or in connection with the use of or access to, or the inability to use or access, the SARMIS website or its content.

SARMIS will use reasonable efforts to ensure that the information and materials provided on this website are accurate. However, SARMIS cannot guarantee the accuracy of all information and materials and assumes no responsibility or liability for the accuracy, completeness or authenticity of the information and materials contained on this website.

You agree to indemnify and hold SARMIS harmless from and against any damage or loss caused by your breach of these Terms of Use or your use of the SARMIS website.

Order and product price

We recommend that you, before placing your order, inform yourself correctly and completely, via messaging or our operators, who are at your disposal at the phones indicated on the site, about the product that is of interest to you, its characteristics, price and conditions of sale. Knowing all these details, you will avoid unpleasant situations that may arise due to the lack of information about the desired product, its quality, replacement or return, since placing an order is equivalent to accepting all the present conditions of sale and delivery of the product.

For products in stock, the order will be confirmed in writing or by phone, no later than the time of delivery of the product, which will be no later than 30 days after the order is placed with the seller; for those that are not in stock at the time of the order, the delivery time will be extended.

The products are sold based on online orders or at the company's headquarters, at the prices displayed on the site on the day of sale.

The total price of the products, displayed on the site, includes the related VAT and, where applicable, the cost of using the means of communication with you in order to sell the products, at standard prices on the network; it does not include the cost of transport, domestic or international.

Payment can be made: either online, by bank card or transfer, or cash on delivery upon receipt of the package. Products can also be purchased directly from the company's headquarters, by paying in cash or by card.

All products whose order was placed online will be sent by courier.

All products are offered within the limits of available stock, therefore SARMIS reserves the right not to honor an order if the product in question is no longer in the current offer on the site. SARMIS undertakes, at the same time, to update the product offer on the site depending on the availability of products in stock.

SARMIS guarantees that the products are new, properly packaged and at the time of delivery are accompanied by a tax invoice, according to the legislation in force.

SARMIS undertakes to correctly display prices and information regarding the characteristics and availability of products on the website www.rainbwow-vision.com. In the event that system errors may occur in the display or calculation of prices. In this case, the final price of the order will be considered the one established by telephone/electronically with the SARMIS sales representative.

The images published on the website next to the products are for example, and the delivered products may differ from those shown in the images. SARMIS does not assume responsibility for the characteristics and specifications of the products displayed on www. sarmisintl.com, these being the responsibility of the brand representatives who provided them or the importers designated by the brands. At the same time, SARMIS reserves the right to modify and update product descriptions without prior notice, depending on its own sales policy.

For any other information or clarification regarding the products or terms displayed on the site, we ask you to submit a written request to which you will receive a response within a short period of time from submission.

The products delivered to you are similar to those displayed on the site and we recommend using them only for the purpose mentioned in the prospectus or on the product label.

Taking physical possession of the product (delivery) and paying for it upon receipt, by courier or at the company's headquarters, is equivalent to the conclusion of the sale. Upon delivery of the product, we are free from any obligation towards you, regardless of its nature, the sale being considered fully executed.

Legal guarantee of conformity

Given the legal obligation of conformity of the seller towards the consumer, SARMIS guarantees the quality of any product it sells and certifies that the products are manufactured according to the highest quality standards and meet all legal marketing requirements, including those relating to the label. For the products sold, we have quality documentation, declarations of conformity, warranty certificates, analysis reports, as appropriate.

We also guarantee to bring the product into conformity in the event of accidental non-conformity, as well as to refund the price paid by the consumer, repair or replace the product if it does not meet the conditions stated in the declarations relating to the warranty or presented in the related advertising. 

Checking and returning products

However, upon receipt of the product, before unsealing it, we ask you to check whether the product, in terms of the content and data written on the packaging, the label and taking into account its presentation, corresponds to the one ordered.

By signing the delivery note, you acknowledge receipt in good condition and in full of the ordered products.

If you identify any discrepancy, you have a period of 14 days in which you can notify us, in writing or in another way that can be proven, regarding this.

You can opt, at the same time and also in writing, to replace the product with a suitable one or to return it to us.

Our products will be returned in the same way they were delivered, and the cost of this return will be borne by us.

If you opt for a return, you should know that only sealed products can be returned, as purchased, according to the specific legislation in force, legislation that you can consult at: "www. anpc.gov.ro" prohibits the return of unsealed products to the seller "for health protection reasons or for hygiene reasons, in accordance with art. 16 letters d) and e) of OUG 34/2014. Also, "products made according to the specifications presented by the consumer or clearly personalized" cannot be returned.

If you choose a different type of delivery for your return than the standard delivery used by us, it is also good to know that from a legal point of view we are not obliged to pay the additional costs generated from this. 

We cannot accept returns of products that have physical changes, knocks, chips, scratches, shocks, etc. The returned products must be in the same condition as upon receipt: without defects (except for hidden defects and excluding defects already reported by the customer in SARMIS correspondence).

In the event that the products are returned with various damages due to the handling of the products, you will receive a refund with the value of the product reduced accordingly. The damage to the products will be ascertained by means of a report, upon receipt of the products by the courier or another person, and proof of their receipt in a modified state can be made by any means. Since we deliver the products to you as a buyer, the risk of loss or damage to the products is transferred to you when you or a third party designated by you, other than the carrier / courier, takes physical possession of the products.

In order to return the product, we ask you to inform us of your intention to return by written request/unequivocal statement, within 14 days from the effective possession of the product or its delivery to you or to the designated person, specifically chosen by you, located at the place of receipt that you specified in the order. Within 14 days from the registration of the request, we will refund the price you paid for the purchase of the product. We reserve the right to postpone the refund of the money until the date of receipt of the products that were the subject of the sale/return or until the moment of receiving proof from you that you sent the products to us, taking into account the earliest date.

Since the product will be delivered by courier, you are obliged to be correctly informed about the terms of sale, which you will be able to learn about through the website or our collaborators. In the same way, we can provide you with information regarding the conformity of the products, as a guarantee of their quality. For products that are not for long-term use, the company is not obliged to provide the consumer, upon purchase, with a certificate of warranty and conformity.

We are confident that our products will satisfy customers from all points of view. If, however, for a specific reason, a customer is not satisfied with one of the products purchased from the website, he may request a refund within 30 days from the date of receipt of the product.

SARMIS may accept the refusal or return of the products following the analysis of the returned products. In case of refusal, it will communicate the reasons for this to the customer. At the same time, the shipment to the Customer of the products not accepted as a return will be made exclusively at the expense and at the initiative of the Customer. If, within 60 days from the date of notification of the refusal to accept the return, the Customer does not take any steps to collect the Product, SARMIS will proceed to destroy it, and may provide the Customer with supporting documents in this regard.

Information, complaints or claims regarding the products can be submitted in writing on our website or at our contact address.

Complaints will be resolved amicably, in compliance with the legal provisions in the field. In the event that an amicable agreement is not reached, the buyer may resort to other means of resolution provided for by the legislation in force.

Validity Clause

If one of the provisions of these Terms of Use of the website becomes invalid or is declared null and void by a court, this will not affect the validity of the other terms.

Choice of law, jurisdiction and venue

The use of the SARMIS website and these terms of use of the website are governed by the laws of Romania. Unless otherwise provided by law, the courts of Romania have exclusive jurisdiction for any disputes arising from or in connection with the use of the SARMIS website or these Terms of Use of the website, and the competent court is the District Court of Bucharest 2.

Final Provisions

In the event that one of the above-presented clauses becomes null and void, the validity of the other clauses will not be affected.
